Fundamental rights: current debates and future challenges

Abstract

From the second half of the s. XX and mainly, based on the horrors that the world witnessed in World War II, a strong current of constitutionalism develops in Europe, manifested, among other aspects, in a special concern for guaranteeing fundamental rights. This line of thought has been called the democratic constitutional model or neo-constitutionalism. Starting the s. XXI it seems relevant to us to study the scope of the debate that has been developed in these matters in such a way that these contributions can serve the Chilean constitutionalism to take on the challenge of adapting the constitutional protection of fundamental rights.
